3.1 The Website is operated by 911Cyber Company and is used to offer cybersecurity, investigation, and related professional services directly to clients (“Services”).
3.2. Services are performed by 911Cyber employees, contractors, or authorized subject-matter experts (“Experts”) acting on behalf of 911Cyber. Users accessing or purchasing Services are referred to as “Clients.”
3.3. While 911Cyber makes commercially reasonable efforts to deliver Services in accordance with agreed scopes and industry standards, 911Cyber does not guarantee specific results, outcomes, or findings. Services involve professional judgment and technical analysis, and outcomes may vary based on factors beyond 911Cyber’s control.
3.4. 911Cyber commits to providing Services in a professional and competent manner, consistent with generally accepted industry best practices and standards applicable at the time the Services are performed.
4.1. Sellers provides cybersecurity, investigation, and related professional services directly to clients. All service fees are determined and will be disclosed to the client prior to the commencement of services. Clients may be required to pay fees in full upfront or according to a milestone-based or installment payment schedule, as agreed in writing.
4.2. Payments are processed through the Website’s designated payment gateway. 911Cyber may apply administrative, processing, or transaction fees, which will be clearly disclosed where applicable
4.3 An initial, non-refundable fee may be charged to cover the costs associated with intake, assessment, scoping, and preliminary investigative or response activities (“Initial Fee”). Once services have commenced, this Initial Fee is non-refundable, as resources, personnel, and tools are immediately allocated. Refunds of the Initial Fee will only be considered in exceptional circumstances and solely at 911Cyber’s discretion and minus transaction fees.
4.4. Refunds. Except as expressly stated in these Terms, all payments are final and non-refundable. No refunds will be issued for Services that have been partially or fully performed, or dissatisfaction with outcomes where Services were delivered as agreed.
5.1. Users are solely responsible for any content they submit, upload, transmit, or otherwise make available through the Website, including but not limited to messages, documents, files, images, and communications. Users represent and warrant that they have all necessary rights and permissions to submit such content and that it is accurate and lawful.
5.2. Users agree not to submit, post, or transmit any content that is unlawful, deceptive, misleading, defamatory, abusive, obscene, or otherwise objectionable, or that infringes upon or violates the intellectual property, privacy, or other rights of any third party.
6.1. The Website and its content, including but not limited to logos, text, graphics, and software, are protected by intellectual property laws.
6.2. Users retain ownership of the content they create, but grant the Website a non-exclusive license to use, display, and distribute the content for promotional purposes.
7.1. Users agree not to engage in activities that violate these Terms, including fraud, spamming, hacking, and interfering with the Website’s operations.

While 911Cyber makes commercially reasonable efforts to deliver services in accordance with agreed scopes, the Website itself does not guarantee specific outcomes, results, or findings from any Expert Services.
8.2. Clients acknowledge that Expert Services involve professional judgment, technical analysis, and investigative processes that may be influenced by factors beyond 911Cyber’s control, including the quality of information provided, system access limitations, third-party dependencies, and evolving threat conditions. As such, 911Cyber does not warrant the accuracy, completeness, or success of any particular outcome.
8.3. Any guidance, findings, reports, or recommendations provided as part of the Expert Services are for informational and professional purposes only and should not be construed as legal, financial, or regulatory advice unless expressly stated in writing. Clients remain solely responsible for decisions and actions taken based on the Expert Services.
9.1. The website reserves the right, at its sole discretion, to suspend, restrict, or terminate any user account that violates these Terms, applicable laws, or engages in conduct that is unlawful, abusive, disruptive, or otherwise inappropriate.
9.2. Users may terminate their accounts at any time by following the account closure procedures provided on the Website or email customer support to request the deletion of their account. Termination does not relieve users of any obligations incurred prior to termination, including payment obligations.
10.1. The Website and all related services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, 911Cyber disclaims all warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement.
11.1. To the maximum extent permitted by applicable law, 911Cyber, its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, or reputational harm, arising out of or related to the use of or inability to use the Website or services.
12.1. 911Cyber may update or modify these Terms from time to time. Material changes will be posted on the Website, and where required by law, users will be notified. Continued use of the Website after such changes constitutes acceptance of the revised Terms.
13.1. These Terms are governed by the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of New York.
